All rights reserved. No part of this publication may be reproduced, distributed, or transmitted in any form or by any means, including photocopying, recording, or other electronic or mechanical methods, without the prior written permission of Next Action Counseling (“Owner”).
All course materials, including presentations, outlines, instructions, recordings, and similar materials (“Course Materials”), are protected by U.S. copyright law. Owner is the exclusive owner of the copyright in those materials. You may take notes and make copies of course materials for your own use. You may also share those materials with another purchaser who has legally obtained the Course Materials.
You may not reproduce, distribute, display, post, upload or disseminate the Course Materials in any other way — whether or not a fee is charged — without the express written consent of Owner. You also may not allow others to do so.
Use or Distribution of Recordings of Course Presentations - Except as provided herein, no business, association, agency, or individual, shall give, sell, or otherwise distribute to others or publish any recording made of or during any course presentation without the written consent of the Owner. This policy is applicable to any recording in any medium, including video, audio, handwritten or typed notes.
Courses are intended for the sole use by the purchaser and are not permitted to be sold or resold to any third party. The entity or individual who has rightfully and validly purchased a Course is permitted by the Owner to distribute the Course materials to their patients for the intended use as described within each Course. The Course and any of the materials within it may not be reproduced, distributed, or transmitted in any form with the intention to sell all of or any portion of such materials or to be used outside of each Course’s intended application (ie: by the purchaser for their patients).
Indemnification. By using and or implementing the course materials (collectively, the “NAC Materials”) you will at all times indemnify, defend, and hold harmless Next Action Counseling, its managers, directors, officers, employees, agents, licensees, successors, and assigns from and against any and all third party claims, damages, liabilities, or expenses, including reasonable attorney’s fees, arising out of any damages as a result of your, your company’s, or your businesses’ use or implementation of the NAC Materials. If NAC shall seek indemnification, you agree to give NAC the right to participate in the defense and settlement of any such claim; provided, however, that you may not, without NAC’s prior written approval, settle or dispose of any claim of which you have agreed to accept the defense.
Exculpation. You expressly waive any and all claims against NAC, direct or indirect, including, without limitation, claims relative to the use and/or implementation of the NAC Materials by you, your company, your business. Furthermore, you agree that NAC shall not be liable to you, your company, your business or any third party for any injury sustained by the you, your company, your business, its employees, independent contractors, invitees, patients, students, or any other third party through the use or implementation of the NAC Materials.
Please note there are no refunds on any digital products or courses.
Medical Disclaimer (Course Material)
Next Action Counseling (“NAC”) is not, nor is it holding itself out to be, a qualified doctor/physician, nurse, physician’s assistant, psychiatrist, psychotherapist, social worker, or any other medical or mental health professional (“Medical Provider”). NAC’s website, blog, resources, courses, text, treatments, dosages, outcomes, charts, profiles, graphics, photographs, images, advice, messages, forum postings, and related content (collectively, “Materials”) includes information and instruction relating to, non-exclusively, treatment protocols, case conceptualization, navigating complex clinical cases, and new research developments, (collectively, “NAC Content”). You acknowledge and agree that the following warnings and disclaimers shall apply to all NAC Materials and NAC Content.
All NAC Content and NAC Materials has been created and published for informational purposes only and is not intended to establish a standard of care or serve as a substitute for the consultation, diagnosis, and/or medical treatment of a qualified Medical Provider.
